The Prime Minister requested the Ministry of Finance to have a solution for petrol stations to issue electronic invoices (e-invoices) for each sale and connect data with tax authorities in December 2023.

The Prime Minister has twice mentioned the implementation of e-invoices in petroleum retail, specifically in Official Dispatch No. 1123/CĐ-TTg dated November 18, 2023, requesting ministries, branches, and localities to strengthen the management and use of e-invoices; Official dispatch No. 1284/CĐ-TTg dated December 1, 2023, requesting ministries, branches and localities to strengthen the management and use of e-invoices for petroleum business and retail activities.

The Prime Minister directed petroleum retail enterprises to prepare e-invoices for each sale and connect data with tax authorities in December 2023. In case the enterprise does not comply or intentionally does not comply, it will be inspected and handled. The Ministry of Finance directs the Tax sector to complete the information technology system with the e-invoices. This system aims to ensure smooth and convenient reception and connection of e-invoice information by tax authorities.

Implementing the direction of the Prime Minister and the Ministry of Finance, recently, the Director General of the General Department of Taxation issued Official Dispatch No. 5468/TCT-DNL dated December 5, 2023, requesting tax authorities at all levels to urgently and drastically implement the direction of the Government and the Ministry of Finance in directing the implementation of regulations on issuing e-invoices after each sale for petroleum retail business.

Accordingly, the Director General of the General Department of Taxation requires the Directors of Tax Departments of provinces and centrally-run cities to carry out some of the following tasks:

Firstly, organizing full and timely dissemination to each leader and civil servant in the unit about the views and directions of the Prime Minister and the Minister of Finance in the above documents to further improve awareness of the organizational and individual responsibilities of officials and civil servants at the unit in organizing the implementation of legal regulations on invoices and documents in the Law on Tax Administration No. 38/2019/QH14, especially is the regulation on preparing an e-invoice after each sale at petroleum retail stores according to the provisions of Decree No. 123/2020/NĐ-CP, which is one of the mandatory and important tasks that must be performed.

Assigning the Director of the Department of Taxation to directly direct the leaders of the Department of Taxation, leaders of Division, Tax Branches, and officials and civil servants to carefully study the content of Official Dispatch No. 13384/BTC-TCT and the direction of the General Department of Taxation at the General Department of Taxation. Document No. 5080/TCT-DNL to advise the People's Committees of provinces and cities to direct the implementation to businesses and retail petroleum stores to issue e-invoices after each sale at petroleum retail stores according to regulations.

Second, reviewing and rectifying tax management for enterprises and petroleum retail stores in the area; deploying effective management solutions to strengthen revenue management to ensure correct collection, and enough income; and promoting solutions to combat fraud and tax loss by the law.

Third, coordinating with competent authorities in the area to advise the People's Committees of provinces and cities to establish interdisciplinary groups to deploy e-invoices for each sale at petroleum retail stores, make specific plans, and immediately deploy synchronous, effective, and drastic solutions to require petroleum retail business units to prepare e-invoices after each sale at petroleum retail stores according to the provisions of law and direction of the Prime Minister and the Ministry of Finance.

The General Department of Taxation said that all organizations, enterprises, individual businesses, and business households that use invoices have switched to using e-invoices. Cumulative results of nationwide deployment by the end of November 2023, the number of e-invoices received and processed by tax authorities is about 5.9 billion invoices (of which 1.7 billion invoices have codes and more than 4, 2 billion invoices without code). To date, there have been 37,542 enterprises and individuals registered to use e-invoices with tax authority codes created from cash registers with the number of invoices with codes originating from cash registers being more than 72.7 million invoices with a total tax amount is 4.208 billion VND. The General Department of Taxation will continue to operate the e-invoice system, speed up the progress of upgrading and completing infrastructure, and ensure smooth operation nationwide, especially in the last month of the year.
