During the process of digital transformation, it is crucial to protect personal data. Vietnam is currently facing a real-world issue, and to address this, the Ministry of Finance has enacted regulations on personal data protection through Decision No. 2813/QD-BTC, dated December 20, 2023. This decision aims to improve the efficiency of state administration in managing personal data. The regulations apply from the date of signing.

The Ministry of Finance's personnel, officials, civil servants, and laborers are all subject to the regulations regarding the security of personal data. These regulations state that personal information handled by the Ministry of Finance comprises information acquired when performing state management duties, Ministry of Finance tasks, and compliance with other legal requirements. The Ministry of Finance's obligations and duties are governed by specific regulations.

The Ministry of Finance maintains the personal data of its civil servants and public employees by legislation related to civil servants and public employees, emulation, rewards, and other relevant regulations. Data regarding digital accounts and personal information of individuals, reflecting past and present activities on information systems under the management of the Ministry of Finance and its units, are maintained in compliance with the laws governing electronic transactions, network security, and information security protection.

The Ministry of Finance is the controller and processor of personal data for the following purposes, except for personal data in classified sectors: personal data mentioned in Points a and b, Clause 1, Article 4 of this Regulation, and the General Departments' degree of management. In regions under decentralized administration and other laws with specific regulations on the roles and obligations of the General Department, the General Department is the controller and processor of personal data. The Ministry of Finance has allowed the General Department to manage information systems or carry out the duties of the system owner, including information about people's digital accounts and personal data that reflects historical activity and actions on those systems.

The regulations designate the Department of Informatics and Financial Statistics as responsible for guiding, pressuring, and inspecting the implementation of this Regulation, as well as the legal provisions and directives of the Ministry of Public Security and the Ministry of Information and Communications regarding personal data protection. The Department also advises and assists the Minister in managing and carrying out the Ministry of Finance's work on personal data protection.

Additionally, units under the Ministry of Finance are in charge of planning, organizing, and overseeing the application of this Regulation and legal rules about the protection of personal data. They are responsible for disseminating and increasing knowledge of the legal requirements regarding the protection of personal data among civil servants, public employees, and subjects in the designated sphere of management. When appropriate authorities request a report on the protection of personal data, they should forward it to the Department of Financial Informatics and Statistics, which will compile it and forward it to the Ministry of Finance for reporting purposes.
